Consumer Lawsuit Dismissed in New York City
A German tourist, identified as Faycal Manz, filed a lawsuit against Los Tocos No. 1, a taqueria in New York City, over a spicy salsa incident in 2024. Manz claimed he suffered from severe post-traumatic symptoms and distress after consuming the self-serve green salsa, which he alleged was not properly labeled as to its spiciness.
The lawsuit demanded $100,000 (Rs 92,36,380) in damages, citing immediate physical problems, including a racing heart, burning tongue sensation, mouth sores, gastrointestinal issues, and emotional distress. However, the court ruled against Manz, stating that spice is often expected in salsa and that a simple online search or reviews would have revealed the salsa's spiciness.
Los Tocos No. 1's lawyers argued that Manz was responsible for his own actions, and the court ultimately dismissed the case. This is not the first lawsuit filed by Manz, as he also filed complaints against Walmart over Wi-Fi access and the NYPD for allegedly refusing to record his statement or investigate an incident involving a homeless person.
