Anthropic v. US Department of War: Judge Expresses Skepticism Over Government's AI Ban

A US District Court judge has expressed concerns over the Trump administration's decision to ban the federal government from using artificial intelligence technology from Anthropic PBC, a leading developer of AI-powered chatbots. During a hearing in San Francisco, Judge Rita F. Lin questioned the reasoning behind the Pentagon's designation of Anthropic as a supply-chain risk, a label typically reserved for US adversaries.

The ban was implemented after a high-stakes dispute between the Pentagon and Anthropic over AI safety concerns. Anthropic had requested assurances that its AI technology would not be used for mass surveillance or autonomous weapons deployment. However, the government cited national security concerns as a reason for not accepting any restrictions.

Anthropic is seeking to block the government's ban and has demanded that the judge remove the supply-chain risk designation and withdraw directives related to it. The company claims that it is being punished for speaking out publicly about the conflict and that the legal principles at stake affect every federal contractor whose views the government dislikes.

The Trump administration has vowed to fight the lawsuit and remove Anthropic from all US government agencies. In court, a lawyer for the government argued that trust is a key component in any relationship between the military and companies providing services, and that Anthropic destroyed this trust by trying to dictate Pentagon policies on AI technology.

However, a lawyer for Anthropic countered that the Pentagon is able to review any AI model before deploying it, and that Anthropic has no control over how the AI software is used by the military.

The case, Anthropic v. US Department of War (26-cv-01996), is ongoing in the US District Court, Northern District of California (San Francisco). A decision on Anthropic's request for a preliminary injunction is expected in the coming days.
