Wind Power Generators Get Relief from Supreme Court Ruling

Key Ruling: The Supreme Court has ruled that state electricity regulatory commissions cannot slash payments made to wind power companies by deducting central government incentives from their earnings.

Impact: The ruling is expected to free up Rs 1,500 crore worth of claims that were stuck in litigation, providing much-needed liquidity to wind power producers.

Background: The case revolved around the Generation Based Incentive (GBI) scheme, introduced by the Ministry of New and Renewable Energy (MNRE) in 2009, which offered wind power developers an incentive of ₹0.50 per unit of electricity to encourage investment in renewable energy. The scheme was discontinued for new projects starting 2017.

History of the Case:

  • 2015: The Andhra Pradesh Electricity Regulatory Commission (APERC) issued tariff regulations stating that subsidies or incentives provided by the government could be considered while determining tariff.
  • 2018: APERC allowed DISCOMs to deduct GBI amounts from payments made to power generators.
  • 2024: The Appellate Tribunal for Electricity (APTEL) ruled in favor of renewable energy companies, stating that GBI was intended to be a benefit "over and above" the tariff determined by state regulators.

Supreme Court Ruling:

  • The Supreme Court held that regulatory authorities cannot nullify legislative or policy intent by deducting GBI from payments made to wind power companies.
  • The Court ruled that GBI is an extra reward for green energy producers, rather than a discount for power distribution companies.
  • The ruling is expected to safeguard revenue streams and enhance bankability of wind power projects.

Industry Impact:

  • The ruling is expected to benefit generating companies by protecting their revenue streams and enhancing bankability of projects.
  • The Court's decision aligns with India's broader energy-transition goals and recognizes GBI as a generator-focused measure tied to the country's climate commitments.

Investor Takeaway

Investors in wind power companies may see a positive impact from the Supreme Court's ruling, potentially leading to increased liquidity and revenue.
